Overview
Welcome to Bag Habit. The terms "we", "us" and "our" refer to Bag Habit. Bag Habit operates this online store and website, including the information, content, features, tools, products and services made available through it (collectively, the "Services").
Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.
These Terms of Service ("Terms") describe the terms that apply when you access or use our Services or purchase from Bag Habit.
Please read these Terms carefully. By accessing or using our Services or placing an order with Bag Habit, you agree to these Terms and the policies referenced within them.
If you do not agree to these Terms, you should not use the Services.
1. Eligibility & Account Information
By using the Services, you represent that you are legally capable of entering into a binding agreement under the laws applicable to you, or that you are using the Services with the involvement and permission of a parent or legal guardian where required.
When placing an order or creating an account, you agree to provide accurate, current and complete information, including your email address, billing information, payment information and shipping address.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity carried out through your account.
You may not transfer, sell, assign or license your customer account to another person.
2. Products & Product Information
We make reasonable efforts to accurately display and describe the products available through Bag Habit, including their colours, materials, dimensions, features and appearance.
Product colours and appearance may vary slightly depending on lighting, photography, screen type, display settings and other factors.
Where natural materials such as leather or suede are used, variations in grain, texture, tone and other characteristics may occur and can form part of the natural character of the material.
Product dimensions may also be subject to reasonable manufacturing or measurement variations where stated.
We may update product descriptions, availability, specifications or other information where reasonably necessary.
We may discontinue products or limit product quantities or availability by person, household, geographic region or jurisdiction where appropriate.
Nothing in this section excludes any guarantee, representation, right or remedy that cannot lawfully be excluded under applicable consumer law.
3. Orders
When you submit an order through Bag Habit, you are making an offer to purchase the products in your order.
Receipt of an order confirmation does not necessarily mean that we have accepted your order. We may need to verify payment, product availability, shipping information or other order details before fulfilment.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- payment cannot be authorised or verified;
- there is an obvious pricing, description or technical error;
- we reasonably suspect fraud or unauthorised activity;
- the order violates these Terms; or
- we are unable to lawfully fulfil or deliver the order.
If we cancel an order after payment has been successfully collected, we will refund the applicable amount to the original payment method unless another method is required or agreed.
Please review your order carefully before submitting it. If you need to request a cancellation or change, contact support@baghabitstore.com as soon as possible.
Because orders can enter processing and fulfilment quickly, we cannot guarantee that an order can be changed or cancelled after it has been placed.
4. Prices, Currency & Payment
Prices, discounts and promotions may change from time to time without notice. The price applicable to your purchase will be the price displayed when your order is placed, subject to the correction of obvious errors as permitted by applicable law.
Depending on your location and store settings, prices may be displayed in different currencies.
Currency conversions may be performed through Shopify or relevant payment services. Your bank, card issuer or payment provider may apply its own conversion rate or fees.
Applicable shipping charges, taxes, duties and other charges collected by Bag Habit will be displayed at checkout where applicable.
You agree to provide current, complete and accurate billing and payment information and represent that you are authorised to use the payment method provided.
5. Shipping & Delivery
Bag Habit ships internationally and works with international fulfilment, warehouse and logistics partners.
Depending on the product, stock availability and destination, orders may be dispatched from international fulfilment locations, including locations in Asia.
Products within the same order may occasionally be dispatched separately or from different fulfilment locations.
Delivery dates and transit times are estimates unless expressly stated otherwise. Delivery may be affected by carriers, customs authorities, weather, transportation disruptions, public holidays, peak periods and other circumstances outside our reasonable control.
Nothing in these Terms limits our obligations or your rights where applicable law provides otherwise.

6. Customs, Duties & Taxes
Where duties, import taxes or other applicable import charges are required for your destination, these will be calculated and collected at checkout where applicable.
You will not be charged by Bag Habit a second time for duties or import taxes that have already been collected as part of your order.
If a carrier or customs authority unexpectedly requests an additional payment relating to duties or import taxes, please contact support@baghabitstore.com before making payment where reasonably possible so we can review the shipment.
7. Returns, Refunds & Exchanges
Returns, refunds and exchanges are governed by our Return & Refund Policy.
Bag Habit currently offers eligible change-of-mind returns requested within 30 days of receiving an order, subject to the conditions contained in that policy.
Our voluntary return policy does not exclude, restrict or modify any consumer rights or remedies that cannot lawfully be excluded.
8. Intellectual Property
The content made available through the Services, including our branding, trade names, logos, text, graphics, photographs, videos, website design, layout and other original content, may be owned by or licensed to Bag Habit and is protected by applicable intellectual property laws.
You may access and use the Services for your personal, non-commercial use. Except as permitted by applicable law, you may not reproduce, distribute, modify, republish, commercially exploit or create derivative works from protected Bag Habit content without permission from the relevant rights holder.
Product names, trademarks, logos or other intellectual property belonging to third parties remain the property of their respective owners.
Nothing in these Terms transfers ownership of Bag Habit, Shopify or third-party intellectual property to you.
9. Third-Party Services & Tools
Our Services may provide access to features, tools or services supplied by third parties, including payment processors, shipping providers, tracking services and other technology providers.
Your use of a third-party service may also be subject to that provider's terms and privacy practices.
To the extent permitted by law, Bag Habit is not responsible for the independent acts, omissions, availability or operation of third-party services that are outside our reasonable control.

We do not control third-party websites and are not responsible for their content, availability, security or privacy practices.

11. Relationship with Shopify
Bag Habit is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Bag Habit.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Bag Habit, including any injury, damage or loss resulting from purchased products and services.
To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages and liabilities arising from or related to purchases and transactions made directly with Bag Habit.

Our collection, use and disclosure of personal information is described in our Privacy Policy.
Because our store is hosted by Shopify, Shopify processes certain personal information in connection with your access to and use of the Services.
Information may also be processed by service providers and partners located in countries other than the country in which you reside where necessary to provide our Services.

13. Reviews, Feedback & Submissions
If you voluntarily submit a product review, photograph, suggestion, feedback or other content to Bag Habit ("Feedback"), you represent that you have the necessary rights to provide that content and that your submission does not violate applicable law or the rights of another person.
Unless otherwise agreed, you grant Bag Habit a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and publish Feedback for purposes connected with operating, improving and promoting our Services, subject to applicable law.
Where you received compensation, a discount, free product or another incentive in connection with Feedback, you must disclose this where required by applicable law.
We may moderate or remove Feedback where reasonably necessary, including content that is unlawful, fraudulent, abusive, misleading, infringing, obscene or otherwise violates these Terms.
14. Errors, Inaccuracies & Omissions
Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability, shipping charges or delivery estimates.
We may correct errors and update information where reasonably necessary.
Where an error affects an order that has already been submitted, we will handle the matter in accordance with applicable law and, where appropriate, contact you regarding the available options.

We may suspend or terminate access to all or part of the Services where reasonably necessary, including in response to fraud, unlawful activity, security threats or material violations of these Terms.
Termination does not affect rights, obligations or liabilities that arose before termination or provisions that by their nature are intended to survive termination.

To the maximum extent permitted by applicable law, we do not guarantee that the website or digital Services will always be uninterrupted, error-free or continuously available.

Nothing in these Terms excludes or restricts any warranty, guarantee, condition, right or remedy that cannot lawfully be excluded or restricted, including applicable statutory consumer guarantees.

To the maximum extent permitted by applicable law, Bag Habit and its affiliates, officers, employees, contractors and service providers will not be liable for indirect, incidental, special or consequential loss arising from your use of the Services where such liability may lawfully be excluded.
Nothing in these Terms excludes, restricts or modifies liability where doing so would be unlawful, or any consumer guarantee, statutory right or remedy that cannot lawfully be excluded, restricted or modified.
20. Indemnification
To the extent permitted by applicable law, you agree to indemnify Bag Habit against reasonable losses, liabilities and costs arising directly from your unlawful use of the Services, your material breach of these Terms, or your infringement of the rights of another person.
This section does not apply to the extent that a loss or liability was caused by Bag Habit's own acts or omissions or where such an indemnity cannot lawfully be imposed.
21. Severability
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will continue in effect to the extent permitted by law.
22. Waiver & Entire Agreement
A failure by Bag Habit to exercise or enforce a right under these Terms does not constitute a waiver of that right.
These Terms, together with the policies and other terms expressly incorporated by reference, constitute the agreement governing your use of the Services, subject to any rights that cannot be excluded by applicable law.
23. Assignment
You may not transfer your rights or obligations under these Terms without our prior written consent where such consent may lawfully be required.
Bag Habit may transfer its rights and obligations in connection with a legitimate transfer, restructuring or sale of the business, subject to applicable law.
24. Governing Law
These Terms and your use of the Services are governed by the laws of Western Australia, Australia, and applicable laws of Australia, without excluding any mandatory consumer protection laws that may apply to you in your country, state, province or territory.
To the extent permitted by applicable law, disputes relating to these Terms may be brought before courts of competent jurisdiction in Western Australia, Australia.
Nothing in this section deprives a consumer of any mandatory rights, protections or jurisdictional rights that cannot lawfully be excluded or restricted.
